‘Dr Death’ Patel to face another trial over manslaughter charges in Australia |
Indian origin surgeon Jayant Patel, who was released from prison last week after the Australian High Court quashed his convictions, will face another trial.
Dr Patel was sentenced to seven years’ jail in July 2010 of three counts of manslaughter and one count of grievous bodily harm during operations at the Bundaberg Hospital , where he worked as a surgeon between 2003 and 2005.
However, in a unanimous decision last week, the High Court quashed his conviction after it found that a ‘miscarriage of justice’ had occurred on the 43rd day of the 58-day trial, opening the door to a retrial.
According to the Brisbane Times, Director of Public Prosecutions Tony Moynihan, SC, confirmed he would pursue another trial against Dr Patel.
“I have carefully considered the judgment and I am satisfied that, on the admissible evidence, there are reasonable prospects of a conviction and it is in the public interest to proceed with a new trial,” Moynihan said in a statement.
“The charges have to be tried separately. Mr Peter Davis, SC, who prosecuted the matter in the High Court, will continue to appear for the Crown,” the report quoted Moynihan, as saying.
