Delhi High Court dismisses petition seeking ban on same gotra marriages

The Delhi High Court on Friday dismissed a petition seeking amendment to the Hindu Marriage Act (HMA) in order to prohibit marriages in the same gotra. One Naresh Kadyan petitioned the High Court seeking ban on same gotra marriages. In his petition Kadyan submitted that same gotra marriage is violative of the fundamental rights and against the Hindu traditions. A vacation bench consisting of Justices S N Dhingra and A K Pathak warned that a heavy cost would be imposed on Kadyan, for wasting the time of the court. Kadyan had urged the court to direct the Union Government for appointment of a commission to bring about the necessary amendments in the Hindu Marriage Act to ban same gotra marriage. He tried to draw the attention of the Court over the Khap Panchayats decision to go on a strike from June 21 to protest marriages in the same gotra. Earlier, the Supreme Court had declined to entertain Kadyan's petition and asked him to approach the High Court.
